1. Definitions

In these Terms and Conditions, the following definitions apply:

Customer means the individual or business requesting and paying for our services.

We, us, our means Rubbish Clearance Stockwell, the provider of rubbish clearance and waste collection services.

Services means any waste removal, rubbish clearance, bulky waste collection, garden waste removal, household clearance, commercial waste collection, or related labour and transportation provided by us.

Booking means a confirmed request for services, whether made by phone, email, online form or in person.

Waste means any materials, items, rubbish, junk, debris, furniture, appliances, or other goods you ask us to remove as part of the services.

2. Scope of Services

We provide rubbish clearance and waste collection services for domestic and commercial customers. The specific scope of work for each booking, including the type and approximate volume of waste, access arrangements, and any additional labour required, will be agreed at the time of quotation and booking.

Unless expressly stated, our services do not include cleaning, disconnection of services such as gas or electricity, dismantling of fixed structures, or removal of hazardous materials. Any additional tasks requested on the day of service are subject to our agreement and may incur further charges.

3. Booking Process

3.1 You may request a quote and make a booking by phone, email or through our online enquiry process. To provide an estimate, we may ask you to describe the waste, provide approximate volumes or weights, and explain the access to the property. We may also request photographs to assist with an accurate quotation.

3.2 Any quotation given based on your description or photos is an estimate only. The final price will be confirmed by our team on arrival, once we have inspected the waste in person and assessed access, parking, and any additional labour required.

3.3 A booking is considered confirmed when we have agreed a date and time window with you and, where applicable, received any required deposit or card pre-authorisation.

3.4 You are responsible for ensuring that all details in your booking confirmation are correct, including your contact information, the service address, and the description of the waste to be collected.

4. Access and Parking

4.1 You must ensure we have safe and reasonable access to the property and the waste to be removed at the agreed time. This includes arranging any entry codes, keys, permits or authorisations required for our team to enter.

4.2 You are responsible for arranging suitable parking for our vehicle as close as reasonably possible to the collection point. Any parking charges or fines incurred as a direct result of the service may be added to your invoice.

4.3 If we cannot gain access or park sufficiently close to carry out the work, we may need to cancel or reschedule the service, and a call-out or cancellation charge may apply.

5. Waste Types and Restrictions

5.1 We handle general household, garden, and commercial waste, including but not limited to furniture, appliances, bagged rubbish, non-contaminated wood, metal, plastics, cardboard, and similar items.

5.2 Certain items cannot be collected as part of standard rubbish clearance services due to legal or safety restrictions. These may include:

Asbestos or suspected asbestos-containing materials

Chemicals, solvents, oils, paints or fuels

Clinical or medical waste, syringes or sharps

Gas bottles and pressurised containers

Explosive or highly flammable materials

Contaminated or hazardous waste as defined by UK regulations

5.3 If you present such items for removal without prior agreement, we may refuse to handle them, and additional charges may apply if we must rearrange the job or if specialist treatment is required.

5.4 You must notify us in advance if you believe any waste may be hazardous or present a health and safety risk. We may request more information, decline the job, or propose alternative arrangements.

6. Waste Ownership and Authority

6.1 By using our services, you confirm that you either own the waste or have full authority from the owner to arrange for its removal and disposal.

6.2 Once we load waste onto our vehicle, it becomes our responsibility and will be transported and disposed of in accordance with applicable waste regulations. We reserve the right to refuse any items at our discretion if we believe they are unsafe, illegal, or not as described at the time of booking.

7. Compliance with Waste Regulations

7.1 We operate in line with UK waste legislation and duty of care requirements. All reasonable steps are taken to ensure waste is transported to licensed waste transfer stations or recycling facilities and that it is processed lawfully.

7.2 Where required, we may issue a waste transfer note or similar documentation recording details of the collection and disposal. You agree to retain any such documentation as evidence of lawful disposal if reasonably requested by authorities.

7.3 We may separate and sort collected waste for recycling or recovery where practicable. The choice of disposal, recycling facility, or transfer station remains at our sole discretion, provided that it complies with relevant regulations.

8. Pricing and Payment

8.1 Our charges are generally based on the volume, type, and weight of waste, as well as labour, access difficulty, and any additional services required. We will explain our pricing structure at the time of booking and confirm the final cost before work begins, wherever possible.

8.2 All prices quoted are exclusive of any parking charges, congestion charges or other third-party fees, unless expressly stated otherwise. Any such costs incurred during the service may be added to your final bill.

8.3 Payment is due upon completion of the service, unless otherwise agreed in writing in advance. We may accept payment by cash, card or bank transfer. For business customers, we may offer account terms subject to credit checks and written agreement.

8.4 We reserve the right to request a deposit or card pre-authorisation to secure a booking. If you cancel outside the permitted period or fail to provide access, this deposit or pre-authorisation may be retained or used to cover applicable charges.

8.5 Where payment terms are agreed in arrears, invoices are payable by the due date stated. We may charge interest and reasonable recovery costs on overdue sums in accordance with applicable UK law.

9. Cancellations and Amendments

9.1 You may cancel or amend your booking by contacting us directly. We request as much notice as possible to reschedule or cancel your rubbish clearance or waste collection.

9.2 If you cancel more than 24 hours before the scheduled service time, any deposit paid may be refundable at our discretion, subject to deduction of any reasonable administrative costs.

9.3 If you cancel within 24 hours of the scheduled service time, fail to be present, or do not provide access when we attend, we reserve the right to charge a cancellation or call-out fee, which may be equal to some or all of the estimated service cost.

9.4 In the event of severe weather, vehicle breakdown, staff illness, or other circumstances beyond our reasonable control, we may need to amend or cancel your booking. In such cases, we will endeavour to notify you as soon as possible and arrange a new time. We will not be liable for any loss resulting from such rescheduling or cancellation, but any deposit paid for the affected booking will be transferable to a new appointment.

10. Service Performance and Customer Obligations

10.1 You must ensure that the waste to be removed is clearly identified and separated from any items you intend to keep. Our team will ask you to confirm what is to be taken before loading. We are not responsible for removing items that were not clearly designated as waste.

10.2 You must ensure that the area where we will be working is safe and reasonably clear of obstacles. If we consider the working conditions unsafe, we may refuse to proceed until the risks are addressed, or we may cancel the service and charge an appropriate fee.

10.3 You agree to treat our staff with respect and not to behave in a threatening, abusive, or discriminatory manner. We reserve the right to withdraw our services immediately if we feel our staff are at risk.

11. Damage and Liability

11.1 We will exercise reasonable care and skill when providing our services. However, minor scuffs or marks may occasionally occur when removing bulky items from confined spaces. You accept that there is an inherent risk of cosmetic damage when moving large or heavy objects through narrow hallways, doorways, or staircases.

11.2 If significant damage to property occurs directly due to our negligence, you must notify us as soon as reasonably possible and, in any event, within 48 hours of the service. We may request evidence, including photographs, and the opportunity to inspect the damage before any repair or replacement is undertaken.

11.3 Our total liability to you for any loss or damage arising from our services shall be limited to the total price paid or payable for the relevant booking. We will not be liable for any loss of profits, loss of business, consequential or indirect losses, or costs arising from delays, cancellations, or failures in performance caused by circumstances beyond our reasonable control.

11.4 Nothing in these Terms and Conditions limits or excludes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be lawfully excluded under UK law.

12. Insurance

12.1 We maintain insurance appropriate to the nature of our rubbish clearance and waste collection services. Details of our insurance cover are available on request.

12.2 Our insurance does not cover items that you have not clearly identified as waste or items that are stored in a way that makes them indistinguishable from rubbish you have asked us to remove. You are responsible for ensuring that valuables, important documents, and items you wish to keep are removed from the clearance area in advance.

13. Complaints

13.1 If you are dissatisfied with any aspect of our service, you should contact us as soon as possible with full details of your complaint.

13.2 We will investigate your complaint and, where appropriate, may offer a remedy such as a partial refund, re-performance of the service, or another reasonable solution, depending on the circumstances.

14. Data Protection and Privacy

14.1 We collect and process personal information such as your name, contact details, service address, and payment information as necessary to arrange and provide our services, manage bookings, and handle invoicing and customer service.

14.2 We will handle your personal information in accordance with applicable data protection laws. We will not sell your details to third parties. We may share information with trusted partners only where needed to deliver the service or meet legal obligations.

15. Variations to Terms

15.1 We may update or amend these Terms and Conditions from time to time. Any changes will take effect when published or otherwise communicated to you.

16. Governing Law and Jurisdiction

16.2 You and we agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising in relation to these Terms and Conditions or the services we provide.

17. General Provisions

17.1 If any provision of these Terms and Conditions is found by a court or competent authority to be invalid, unlawful or unenforceable, that provision shall be treated as deleted, but the remaining provisions shall continue in full force and effect.

17.2 No failure or delay by us in exercising any right or remedy under these Terms and Conditions shall operate as a waiver of that right or remedy, and no single or partial exercise shall prevent any further exercise of that or any other right or remedy.

17.3 You may not assign or transfer any of your rights or obligations under these Terms and Conditions without our prior written consent. We may assign or transfer our rights and obligations to another suitably qualified provider, provided this does not materially affect your rights.
